1. Acceptance of Terms

By accessing or using DeadlineKeeper ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

DeadlineKeeper is a web application that helps students track college application deadlines, manage essays, scholarships, and recommendations. The Service includes features such as deadline reminders, calendar synchronization, AI-powered essay feedback, and voice assistant capabilities.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You may not share your account with others or create multiple accounts.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code or attempt to compromise our systems
  • Impersonate others or provide false information
  • Interfere with other users' access to the Service
  • Scrape, crawl, or collect data from the Service without permission
  • Use the Service to send spam or unsolicited communications
  • Attempt to reverse engineer or copy the Service

5. User Content

You retain ownership of all content you create or upload to the Service (essays, applications, etc.). By using the Service, you grant us a limited license to:

  • Store and display your content to you and authorized users (parents, counselors)
  • Process your content through AI services for features you request (essay feedback)
  • Create anonymized, aggregated statistics to improve the Service

We will never sell your personal content or share it with third parties for marketing purposes.

6. Subscriptions and Payments

  • Some features require a paid subscription or credits.
  • Payments are processed securely through LemonSqueezy.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • Refunds are handled on a case-by-case basis. Contact support for assistance.
  • We reserve the right to change pricing with 30 days notice.
  • Credits do not expire and are non-refundable.

7. AI Features Disclaimer

The Service includes AI-powered features (essay feedback, voice assistant, suggestions). These features are provided for informational purposes only and should not be considered as professional advice. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all AI-generated suggestions before using them in your applications.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT RESPONSIBLE FOR:

  • Missed deadlines or application failures
  • Accuracy of deadline information or suggestions
  • College admission decisions
  • Data loss due to technical issues
  • Third-party service outages (Google, Microsoft, etc.)

IN NO EVENT SHALL OUR LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS.

9. Indemnification

You agree to indemnify and hold harmless DeadlineKeeper and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

You may terminate your account at any time through your account settings. We may terminate or suspend your account for violations of these Terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data before termination.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Educational Institution Terms

When the Service is used by an educational institution ("School") under a school license agreement:

  • The School's Data Processing Agreement governs the handling of Student Data and takes precedence over conflicting provisions in these Terms.
  • The School is responsible for obtaining necessary parental consent for students under 18 where required by applicable law.
  • Student accounts created under a school license are managed by the School's designated administrator.
  • Upon termination of the school license, all Student Data will be deleted within 60 days, with an option to export data prior to deletion.
  • The School may designate counselors and administrators as authorized users with access to student progress data.

13. Governing Law

For individual users: these Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Paris, France.

For educational institutions in the United States: the Data Processing Agreement is governed by the laws of the State in which the institution is located and applicable federal law, including FERPA. Any disputes related to Student Data shall be resolved in the federal or state courts located in the State of the institution.
